Medlin v. Collins (24-3304)

The U.S. Court of Appeals for Veterans Claims held that the Board of Veterans’ Appeals satisfied its duty to provide a statement of adequate reasons or bases for its decision because it provided findings and explanations as to all material issues of fact and law, it analyzed and discussed the credibility and relative probative value of the material evidence, it explained which items of evidence it regarded as more persuasive than others, and it provided reasons for rejecting the Appellant’s reading of potentially favorable evidence.

U.S. Court of Appeals for the Federal Circuit

 

Janich v. Collins (22-5960)

Decided on March 5, 2026

 

The Federal Circuit clarified the findings of Smith v. Shinseki regarding the VA’s obligations in analyzing TDIU and concluded that the Veterans Court imposed too rigid of a standard in deeming a violation of those obligations to be harmless error.

 

Mackey v. Collins (24-1854) (CAVC No. 22-5693)

Decided on March 30, 2026

 

The U.S. Court of Appeals for the Federal Circuit held that the U.S. Court of Appeals for Veterans Claims properly affirmed the Board of Veterans’ Appeals denial of the Appellant’s claim for special monthly compensation (SMC) under 38 U.S.C. § 1114(s) because the Appellant did not have one-service connected disability that was rated as totally disabling and his total disability rating based on individual unemployability (TDIU) was not based on one disability.
